These places have been closed for months with no ETA for when they can open again. What if your employer told you that and you weren’t sure when you were going to get your next pay check? Hello. Please don’t allow anybody to be fined for having their restaurant open at any time. The dictator Newsom has no right to take away jobs, restaurants, clubs, bars and entertainment that offer happiness in California as well as much needed income. Please don’t allow the ABC to revoke any of their licenses. They have a right to be open and this is not fair to revoke their licenses without a hearing. They should be free to open at any time. People needs restaurants, nightclubs and bars to open fully with no restrictions as this gives many people their jobs back and keeps people happy as Americans should be. There is no evidence of anyone catching a virus in a restaurant and even if there was, it’s an adult’s choice to take their risks if they wish.

The spread happens in hospitals and nursing homes so they are the ones who should be diligent and limit their capacity. Please don’t allow this to happen and tell the ABC that they CANNOT revoke licenses if businesses choose to stay open.

Cars cause accidents every day but we don’t ban driving now do we? This governor is a a malicious idiot who parties at the French Laundry restaurant while taking away income from bar and restaurant workers. It’s not right. Take away his salary and see how he likes it. Thank you.

Please leave our California restaurants alone…do not revoke their liquor licenses or restrict them in any other way from doing business as usual.

I am an Environmental Health and Safety Researcher…this means I have access to research and current information far beyond most people who simply listen to the nightly news – news that is scripted by government and corporate actors and often based on information that is not current at all.

It is absolutely clear: data collected from inside and outside the U.S. indicates that the pandemic is over. It is confusing because there are many who are still PCR testing positive however, by the WHO’s and the CDC’s own admission, the PCR test is – for a variety of reasons – producing up to 95% false positive results!!!!!

ASYMPTOMATIC PEOPLE DO NOT SPREAD COVID19.

Finally, it is my understanding that revoking a restaurant liquor license without proof of unlawful action is violation of due process. Serving food and alcohol to consenting, paying customers is obviously not unlawful.

It has come to my knowledge that the state of California is now demanding that any bar /restaurant can have its liquor license revoked without due process of a hearing at the whim of the governor’s office.

If I may remind the ABC control office that it takes many days and even weeks to apply for and receive such a license , and to have it illegally revoked(unfairly) shows poor judgment and vindictive attitude towards business .

I, Kandice Judson a resident and registered voter in the state of California vehemently oppose any changes to the Alcoholic Beverage Control processes, procedures, guidelines, or regulations as they relate to the ongoing covid response or any future response related to potential viral spread.

The operation of private businesses is a right in this country and in this state. It is NOT the state’s responsibility to determine or regulate the risk of viral contagions on the populace. It is, in fact, the individual’s responsibility to determine their own level of risk when leaving their h0me or dwelling each day.

Public health orders are NOT laws and should include expiration dates. California is one of the only states with the highest restrictions AND highest case/fatality rates. California state officials have admitted that restaurants do NOT contribute to the spread of covid and that the state is enforcing closures in an effort to control the people within the state. This is a clear violation of individual rights and the rights of those business owners simply trying to stay afloat. Additionally, the ABC making the determination of whether a business remaining open is a “public health threat” without due process including proof and evidence that said business has directly contributed to the death of a patron or patrons is unlawful and an extreme abuse of power.

Finally, revoking an ABC license in an attempt to punish a business for remaining open is also an abuse of power and moves California further into a dictatorial state which 100% contradicts the very principles and values this nation was founded on.

I have been informed that MY State of California has threatened businesses is to send restaurants a warning that their alcohol license can be suspended if they do not comply with Governor Gavin Newsom’s public health orders.

I have recently been made aware of a measure being discussed, regarding restaurants and Covid non-compliance. And with respect, shame on you guys for threatening to revoke a license!

I think now is time to say: enough is enough! To deny a businesses right to operate and make a living (for owner and staff) is 1) already harsh beyond the reality of this “pandemic,” and 2) to even consider revoking a license without the due process of law/a hearing is borderline unconstitutional.

I find it abhorrent that there is even talk that such a measure could be in place. It is well-known that the state cannot provide concrete, scientific evidence proving the relationship between restaurants and the Covid spread.
The actions, and now this ‘threat,’ are part of a slippery slope. The state is abusing its power, and to even consider this sort of ‘punishment,’ only likens lawmakers to bullies in the playground. Your constituents have had enough!
You have had your paychecks during this time. Restaurant owners and their employees have not been so lucky. So, to strip them of this license (that takes a long time to acquire ), AND to do so without due process, well, to repeat: enough is enough!

I am writing in response to the ABC’s planned change in regulations regarding Gavin Newsom’s health order. I strongly object to these changes as a citizen of San Diego County and employee of an impacted business on the ground that they:

Violate the constitution by suspending licenses without due process.
Are an abuse of power, as constituents do not support it.
Are not based on scientific fact proving that bars and restaurants are not responsible for COVID-19 spread. When restaurants close, people gather in their homes (I have seen this firsthand), and are more likely to be in closer contact.
Violate the constitutional right of citizens to assemble freely.
Illogically discriminate against small business owners, as big box stores are still allowed to remain open, and are just as dangerous to the spread of the virus. The mask requirements enforced in these stores give customers a false sense of security leaving them to come into closer contact, when masks are not a sufficient replacement for social distancing.

Please consider refraining from instituting this massive government overreach. I am in constant contact with members of the public, who do not support this. Businesses are closing by the dozens, and taking their tax money out of the state. I further know a handful of people who have moved out of California, and I will be leaving as well if my workplace is forced to close. I strongly believe this move would work to collapse San Diego’s tourism-reliant economy. Many San Diegans are taking vacations to Arizona right now just to enjoy a normal way of life. That is money that should be spent here.

There are many other reasons these orders should not be implemented, (questionable reliability of PCR tests, imminent vaccine availability, ICU capacity affected by Mexican nationals being shipped to SD hospitals, lockdown effects worse than covid effects, etc.) as I’m sure many others have detailed for you. I know many local businesses that will be coming together to take legal action against this. Please consider what side of history you would like to be on; the one of unconstitutional oppression, or the one of freedom and compassion. The right side will win out in the end. I have several friends who work in the restaurant/bar/hotel industry who have lost their jobs and are unemployed. I recently met a musician who is on the verge of homelessness due to loss of work at the venues that employed him.

The reality of our situation is this: We have passed the point of no return for many San Diegans — they will not get their jobs back.

I urge you to take the silent suffering of thousands of families who rely on the restaurant business seriously. It is heart breaking that I should even have to request this.

You know well that revoking a restaurant’s license without a hearing is a violation of due process. You also know — since you keep up with the public data on covid — that the virus is not doing considerable damage to San Diego and that it is illogical to blame restaurants for any virus spread.

You know the truth. Take your position of power to aid those who have really suffered during this pandemic: business owners, their employees and their families and children.

The draconian measures being taken today already have had a horrific ripple effect on our people across the city. I am writing to you as a concerned citizen of the great state of California. This pandemic may be the most complex crisis the world has ever faced, in that we have never had people moving all over the planet this rapidly with the potential to spread a virus. I was in favor of the initial lock downs in March/April 2020, as the world was unsure of what harm this virus may bring. However, I was NOT in favor of the lockdowns imposed in December 2020, a few weeks before the holidays.

At this point in the pandemic we know that the survival rate is approx. 99.8%. Though I believe we should be careful of the virus, I think the threat to our economy and the small businesses is more dangerous. I propose the following:

To whom it may concern.

Please hear our plea!! We need to re-open California restaurants/bars to save the owners and their families from bankruptcy. The trickle down effect is tremendous.

As a concerned citizen of San Diego CA, a taxpayer, and a voter – I take issue to the proposed changes to TITLE 4. DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL PROPOSED REGULATIONS §147. Emergency Decision Procedures for Administrative Actions against Alcohol Licenses.

Revoking a license without a hearing is a violation of due process and is not fair to the business owner or our established rules as a society. The hearing is to protect them. People should be able to make their own decisions about visiting an establishment.

It is expensive and time-consuming for a small businesses to obtain a license and revoking an ABC license to attempt to punish a business for staying open is an abuse of power.

As a taxpaying constituent I formally oppose these changes to Title 4. Please leave the law as is.

I have been informed that MY State of California has threatened businesses to send restaurants a warning that their alcohol license can be suspended if they do not comply with Governor Gavin Newsom’s public health orders.

The Department of Alcohol Beverage Control now wants to be able to REVOKE a restaurant’s license WITHOUT a hearing if they try to stay open and fight these ridiculous oppressive orders from Governor Newsom.
The State knows that open restaurants are NOT a driver of the spread and there is no scientific evidence to back them up.
The State wants to punish and ruin anyone who does not comply and submit. (comply and submit. How pathetic are those two words!)

I am a taxpayer and a registered voter and I am getting FED UP with rights being removed and revoked.

I strongly oppose the treat of revoking business licenses due to businesses remaining open and exercising their constitutional right. To revoke a restaurant’s license without due process is a violation of the constitution. It is a lengthy and expensive process to obtain a license and what you are threatening to do is WRONG. It would be punishing people for just trying to survive. The constitution states we have the right to “life, liberty and the pursuit of happiness”. These business owners need their businesses to be open to survive to sustain their “life”.
The governor stated he would base his decisions on science. He now states the information is too complicated for the public to understand. There has been no data or scientific evidence that these businesses cause the spread of COVID 19. This is government overreach and unlawful, in addition to crimes against humanity!!!
REOPEN CALIFORNIA and leave these businesses alone! Businesses remaining open are not breaking any laws; however, the ABC revoking licenses is UNLAWFUL and UNCONSTITUTIONAL!
