Who May Obtain a Private Warehouse Permit
A Private Warehouse Permit is for those licensees who want to store alcoholic beverages other than state tax paid beer and wine in a private warehouse. State tax paid beer and wine may be stored anyplace in the State without the necessity for any additional licensure.
How to Apply
Submit a completed Application/Permit for Private Warehouse (Form ABC-241) to the ABC District Office in which your licensed premises is located. Only the signature of one licensed principal is required. The application must also include the applicable fee as identified in Business and Professions Code Section 23106(c). For the accurate fee amount, ensure you are reviewing the most recent version of the ABC Act. You may also contact your local ABC office for fee information and assistance with completing Form ABC-241.
Most applications for a Private Warehouse Permit will require an inspection of the proposed warehouse by an ABC representative. Your application for a Private Warehouse Permit is considered to be approved and issued once it is signed by an ABC Supervisor. The original signed Form ABC-241 will serve as your permit. Once you’ve submitted your application, the fee is non-refundable.
Location of Private Warehouse
In most instances, the Private Warehouse must be located within the limits of the county in which your licensed premises is located. However, a Private Warehouse Permit may be issued to a licensed airline for the purpose of storing alcoholic beverages at an airport in any county which the licensed airline has a scheduled flight.
Other Legal Requirements/Considerations
- Post the approved original Form ABC-241 at or near the entrance of your Private Warehouse.
- A Private Warehouse Permit allows only for the storage of alcoholic beverages. Sales and/or deliveries of alcoholic beverages from a Private Warehouse to consumers or other licensees without an additional license for the warehouse are prohibited.
- Retail licensee(s) with a Private Warehouse Permit may use the Private Warehouse to ship alcoholic beverages to themselves in other counties in which they are also licensed.
- A Private Warehouse Permit is only intended for use by the requesting licensee. It shall not be used for the storage of alcohol for or on behalf of another licensee.
