Operating Restrictions:

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The licensee(s) or an employee of the licensee(s) will be present in the patio at all times that alcoholic beverages are being served or consumed.

Entertainment provided on the patio shall be limited to a guitar, steel drum or key board. There shall be no amplified entertainment on the patio at any time.

Entertainment provided shall not be audible beyond fifty (50) feet from the patio area in any direction.

Consumption of alcoholic beverages in said patio shall be permitted only between to hours of 11:00 a.m.to 12:00 midnight each day of the week.

Sales and service of alcoholic beverages on said patio shall be restricted to a portable bar only and only to patrons using the patio.

No patron will be permitted to carry an alcoholic beverage from interior portion of the premises to said patio area, nor from said patio area to the interior portion of the premises.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.
