Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 a.m. and 2:00 a.m., daily.

Sales and service of alcoholic beverages shall be permitted only between the hours of 11:00 a.m. and 1:00 a.m., Sunday thru Wednesday, and 11:00 a.m. and 2:00 a.m., Thursday thru Saturday.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.

No “happy hour” type of reduced price alcoholic beverage promotion shall be allowed.

Petitioner(s) shall not require an admission charge or a cover charge, nor shall there be a requirement to purchase a minimum number of drinks.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 11/18/2021 and ABC-253 dated 11/18/2021.

Petitioner(s) shall make no changes in the premises interior without prior written approval from the Department.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

The premises shall be maintained as a bona fide eating place (restaurant)with an operational kitchen, and shall provide a menu containing an assortment of foods normally offered in such restaurants. Food service shall be available at all times during normal operating hours.

The boundaries of the patio will be clearly defined and designated by the physical barriers to separate it from the public sidewalk and adjacent private property which it is not under the exclusive control of the licensee(s). These barriers and boundaries as approved and designated on the ABC-257 dated 11/18/2021 and shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

There shall be no live entertainment of any type, including but not limited to live music, disc jockey, karaoke, topless entertainment, male or female performers or fashion shows.

The licensee(s) or an employee of the licensee(s) will be present in the patio at all times that alcoholic beverages are being served or consumed.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The petitioner shall maintain order on the premises over which it has control to prevent loitering or other activity which would interfere with the quiet and peaceful enjoyment of nearby residents.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 11/18/2021 and ABC-253 dated 11/18/2021.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

The license is prohibited from allowing the use of the premises by outside promoters.
