Operating Restrictions:

Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 9:00 AM to 12:00 AM Sunday through Thursday and 9:00 AM to 1:00 AM Friday and Saturday.

The premises shall be maintained as a bona fide food restaurant and shall provide a menu containing an assortment of foods normally offered in such restaurants.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The quarterly gross sales of alcoholic beverages shall not exceed the quarterly gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a quarterly basis and shall be made available to the Department on demand.

There shall be no live music or amplified music on the patio at any time.

There shall be no dancing allowed on the premises.

There shall be no amusement machines or video game devices in the premises at any time.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as defined on the ABC-257 dated 5-22-2020 and ABC-253 dated 5-22-2020.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

There shall be no exterior advertising or sign of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation of this condition.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the ABC-257 dated 5-22-2020 and ABC-253 dated 5-22-2020.

Sales, service and consumption of alcoholic beverages on the rooftop and restaurants patio's shall be permitted only between the hours of 10:00 AM and 8:00 PM daily.

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 5-22-2020 and ABC-253 dated 5-22-2020.

Between the hours of 9:00 PM and 5:00 AM the petitioner(s) shall provide 1 security personnel to patrol the hotel perimeter and its general vicinity and shall maintain order therein and prevent any activity which would interfere with the quiet enjoyment of their property by nearby residents. Said personnel shall be clothed in such a manner as to be readily identifiable as security.

The petitioner shall provide for the availability of valet service for vehicles at all times.
