47 - ON-SALE GENERAL EATING PLACE
Operating Restrictions:
Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 a.m. and 2:00 a.m. each day of the week.
The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control, as depicted on the ABC-257 dated 12/10/2017 and ABC-253 dated 12/10/2017.
Petitioners shall not permit their patrons or the general public to loiter or congregate on the sidewalks adjacent to the licensed premises.
Noise shall not be audible beyond the area under the control of the licensees.
The interior lighting maintained therein shall be sufficient to make easily discernible the appearance and conduct of all persons and patrons in that portion of the premises where alcoholic beverages area sold, served, delivered or consumed.
There shall be no coin operated video amusement devices that would constitute gambling, or represent and/or simulate any game of chance.
The licensee shall comply with the provisions of Section 23038 of the Business and Professions Code and acknowledges that incidental, sporadic, or infrequent sales of meals without actual sales shall not be deemed sufficient to consider the premises in compliance with the aforementioned code section.
During normal meal hours the premises shall be designed and used for and must possess the necessary utensils, table service and condiment dispensers with which to serve meals to the public.
The monthly gross sales of alcoholic beverages shall not exceed the gross sales of food during the same period. The licensee shall at all times maintain records which reflect separately the gross sale of food and the gross sales of alcoholic beverages of the licensed business. Said records shall be kept no less frequently than on a monthly basis and shall be made available to the Department on demand.
