Operating Restrictions:
In the event that the parking spaces in "Brentwood County Mart" located on the Eastern side of 26th Street become unavailable, permanently or for a continuous period of thirty days or more, to the patrons of Holy Cow, the petitioner shall provide eight (8) parking spaces for the use of its patrons for the period commencing on the date the Brentwood Country Mart parking spaces become unavailable and ending on the date Holy Cow reacquires the use of such spaces.
Adequate signage shall be placed on the premises or on the parking lot directing patrons to park in said off-street parking places, which parking places shall be available to patrons of Holy Cow free of charge.
The petitioner shall not accept deliveries of alcoholic beverages on weekends before 11:00 am nor after 4:00 pm, nor weekdays before 9:00 am nor after 6:00 pm. The petitioner shall not permit more than five (5) deliveries of alcoholic beverages per week.
The petitioner shall not convert the type 41 license to a "general" license which permits the sale of alcoholic beverages other than beer and wine.
The petitioner shall not expand the area of its premises by more than 125% nor the seating to more than 100 seats.
There shall be no exterior advertising of any kind or type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages.
The petitioner shall not permit any advertising in the interior of its premises which glamorizes or promotes the sale of alcoholic beverages by the use of sensuous bodies.
The petitioner shall not in its direct mail advertising devote more than 15% of the menu are on such advertising to alcoholic beverages nor shall the print in such advertising for alcoholic beverages be set forth in a larger or bolder type than the print for the remainder of the menu items.
The petitioner shall not sell any alcoholic beverages to any of its employee immediately before, during or immediately after the working periods of such employees. Nor shall the petitioners permit employees to drink alcoholic beverages on the premises immediately before, during or immediately after the working periods of such employees.
The petitioner shall be responsible to clean and remove any graffiti on the building in which its premises are located or litter on such premises within 48 hours of the petitioner obtaining knowledge of the same.
Upon receipt of written permission from the owners of property on the west side of the alley adjacent to the building on which the petitioner's premises are located, the petitioner shall be responsible to clean and remove any graffiti from the walls on the west side of such alley within 48 hours of the petitioner obtaining knowledge of the same.
For any alcoholic beverage containers which were sold to patrons at the petitioner premises, the petitioner shall be responsible to clean up such containers from all public areas within a 100' - foot radius of the petitioner's premises within 24 hours of the petitioner obtaining knowledge of the presence of the same.
The petitioner shall ensure that all trash from its premises is placed within a dumpster. The petitioner shall not permit its trash to remain on the ground nor in the alley, nor in cardboard boxes located on the premises or in the alley.
The petitioner shall provide at least two off-street parking places to be used by its delivery drivers, who shall not park in the alley adjacent to the premises.
The sale of beer and/or wine for consumption off the premises is strictly prohibited.
The petitioner shall not permit any of the following to be located on the premises; coin-operated amusement games, exterior pay phones, coin-operated newracks, or benches which remain outside the premises after the premises are closed to the public.
Sales, service and consumption of alcoholic beverages shall be permitted only between the hours of 11:00 am and 10:00 pm every day of the week.
