Said patio/terrace/other area shall be fully enclosed with a fixed barrier.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

At any time the licensee is exercising retail privileges on the licensed premises, the licensed premises shall have equipment suitable for the commercial manufacture of distilled spirits located permanently on-site that is regularly and consistently used in a bona fide manner for the commercial manufacture of distilled spirits. At any time the licensee is exercising retail privileges on the licensed premises, distilled spirits manufactured on the licensed premises shall in a bona fide manner be offered for sale to consumers for consumption on or off the premises. In determining whether the licensee is offering distilled spirits manufactured on the licensed premises for sale in a bona fide manner, the Department may consider, without limitations, whether, and the extent to which, the licensee has such distilled spirits conspicuously displayed among its offerings of alcoholic beverages for purchase and such distilled spirits are in fact available for purchase.
