Full and complete meals must be offered and made available at all times the premises is exercising the privilege of selling wine and beer that is not manufactured by of for the licensee.

WHEREAS, Business and Professions Code Section 23389, subdivision (c)(2) provides that a beer manufacturer at a licensed branch office may sell only beer that is produced and bottled by, or produced and packaged for, the licensee to consumers for consumption on or off the premises; and, WHEREAS, Business and Professions Code Section 23389, subdivision (c)(3) provides that a beer manufacturer at a licensed branch office may sell wine and beer that is not manufactured by or for the licensee to consumers for consumption in a bona fide eating place as defined in Section 23038 which is located on the licensed premises; and,

Said patio/terrace/other area shall be fully enclosed with a fixed barrier.

A sign shall be posted in a conspicuous space at the entrance/exit point of said patio/terrace/other area, which shall state, “NO ALCOHOLIC BEVERAGES BEYOND THIS POINT”. Said sign shall measure no less than seven inches by eleven inches (7” x 11”), and contain lettering no less than one (1) inch height.

Sales, service and consumption of alcoholic beverages shall be permitted in or on the patio area only between the hours of (10:00AM and 10:00pm), each day of the week.

The licensee(s) or an employee of the licensee(s) will be present in or on the patio/terrace/other area at all times that alcoholic beverages are being served or consumed.

Entertainment provided shall not be audible beyond the area under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s) as depicted on the most recently certified ABC-257 and ABC-253.

Any graffiti painted or marked upon the premises or on any adjacent area under the control of the licensee(s) shall be removed or painted over within 72 hours of being applied.

The use of any amplifying system or device is prohibited on patio/terrace/other area, and the use of any such system or device inside the premises shall not be audible outside the premises.
