Operating Restrictions:

The licensee(s) or an employee of the licensee(s) will monitor the patio at all times that alcoholic beverages are being served or consumed, to ensure that the premises will operate in compliance with all applicable laws and/or conditions.

The boundaries of the patio will be clearly defined and designated by physical barriers to separate it from the public sidewalk and adjacent private property which is not under the exclusive control of the licensee(s). These barriers and boundaries shall not be changed without prior approval of the Department of Alcoholic Beverage Control.

The sale of alcoholic beverages for consumption off the premises is strictly prohibited.

Entertainment provided shall be limited to recorded music. No noise from said entertainment shall be heard from the exterior of the premises.

The subject alcoholic beverage license shall not be exchanged for a public premises type license nor operated as a public premises.

Petitioner(s) shall regularly police the area under their control in an effort to prevent the loitering of persons about the premises.

At all times during normal meal hours, during which the licensee is exercising the privileges of the applied for license, said licensee shall offer meals consistent with what is customarily offered during said meal period. Normal meals are considered to be at least, but not limited to: Breakfast, 6:00 a.m. to 9:00 a.m., Lunch, 11:00 a.m. to 2:00 p.m., Dinner, 6:00 p.m. to 9:00 p.m.

The premises shall be equipped and maintained in good faith and shall possess, in operative condition, such convenience for cooking foods as stove, ovens, broilers, or other devices as well as pots, pans or containers which can be used for cooking or heating foods on the type heating device employed.

The licensee(s) shall make actual and substantial sales of meals to guests for compensation and quarterly gross sales of alcoholic beverages shall not exceed the gross sales of meals during the sale period.

The hours of operation shall not exceed 11:00 A.M. to 9:00 P.M.

No alcoholic beverages shall be consumed on any property adjacent to the licensed premises under the control of the licensee(s).

The petitioner(s) shall be responsible for maintaining free of litter the area adjacent to the premises over which they have control.

The petitioner(s) shall be responsible for removing graffiti from the premises and all parking lots under their control within 72 hours of application. If the graffiti occurs on a Friday or weekend day, or on a holiday, the licensee shall remove the graffiti 72 hours following the beginning of the next weekday.
